The Brick Drayton Valley's Furniture Photo Contest

This contest shall be conducted by The Brick Warehouse LP (“The Brick”) exclusively at The Brick’s Drayton Valley store at 5212 – 50 Street, Drayton Valley, AB (hereinafter referred to as “Store”). A participant shall be referred to as “You” or “Your”.

1. HOW TO ENTER

You must live within the Drayton Valley postal code region and/or within one hundred (100) km of the Store address.

To enter, You must make an upholstery purchase at the Store. After purchase, Your sales associate will invite You to send a photo of Your recent Brick furniture set purchase to jhamdon@thebrick.com (“Entry”).

You are encouraged to be as creative as possible with Your Entry.

Do not purchase method of Entry:

To Enter without purchase, You must write a 1000-word essay on “why would You choose to purchase furniture from The Brick” and send it to jhamdon@thebrick.com.

Contest dates: Commencing Wednesday, November 1, 2023, at 10:00 a.m. MST, until the close of business on Sunday, December 31, 2023. (“Contest Period”)

“Draw Date” – Thursday, January 4, 2024 at 11:00 a.m. MST

Odds of winning decrease as the number of Entries submitted increase during the Contest Period.

2. WHO CAN ENTER:

The Contest is open to all residents of Alberta who have reached the age of majority on or before the Draw Date except employees, representatives, agents, and affiliates of The Brick and Leon's Furniture Ltd. and their immediate family members living in the same household.

You agree to abide by the Contest Rules as set out herein, subject to all federal, provincial and municipal laws.

It is a condition of eligibility that the winner authorizes The Brick to announce and publish his/her name, address and photograph, without remuneration or consideration, in any forthcoming publicity.

3. PRIZE

There is one (1) prize to be won, listed below.

• One (1) $500 Brick Gift Card to be used towards upholstery attachments, such as coffee tables, lamps, rugs, etc.

Prize must be accepted as awarded and is not convertible to cash. Prize is non-transferable, non-exchangeable, and non-refundable.

4. DRAW DATES AND PROCEDURES FOR DETERMINING WINNER

On the Draw Date, a representative from The Brick’s Drayton Valley location will collect and combine all of the Entries and essays submitted to the provided email address, then draw and record two (2) Entries to obtain one (1) winner (“Eligible Winner”). The additional Entry drawn is a back-up Entry in the event that the initial Eligible Winner is non-responsive after contact, fails to comply with the Contest Rules, or is unable to complete the skill-testing question (“Alternate Winner”).

The Brick representative will use his/her reasonable efforts to contact the Eligible Winner by phone or e-mail after the Draw Date. If an Eligible Winner cannot be reached by telephone or has not contacted The Brick within three (3) days of The Brick leaving messages to do so (“Contact Date”), then that person will be disqualified, and The Brick shall proceed to contact the Alternate Winner.

5. DECLARING WINNERS

The Eligible Winner whose Entry form has been selected on the Draw Date must:

1. within three (3) business days following the Contact Date, correctly answer a timelimited arithmetical skill-testing question without the assistance of any person or mechanical/recording device(s). The skill-testing process shall be administered at a prearranged time and place; and
2. execute a declaration and release form confirming compliance with the contest rules and acceptance of the Prize.

Should the Eligible Winner fail to answer the skill-testing question correctly or is unable to attend at the time and place designated by The Brick for the administration of same, that Eligible Winner shall be disqualified, and the skill-testing question shall be administered to the Alternate Winner.

6. ADDITIONAL TERMS:

By participating, You agree that: a) these Official Contest Rules and The Brick’s records of the draw or any other aspect of this Contest shall be final and conclusive in all respects; and b) release, discharge, indemnify and hold harmless The Brick and its trustees, directors, officers, and employees from any liability, claims, damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize.

7. LIMITATION OF LIABILITY

The Brick assumes no responsibility or liability for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an Entry). If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of The Brick which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, The Brick reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest.

8. PRIVACY POLICY

By entering the Contest, You agree to The Brick’s use of Your personal information for the purpose of administering this Contest and in accordance with The Brick’s Privacy Policy.

The Brick will use the contact information provided in contest entries for administration of this Contest. By entering this contest, You acknowledge and agree to give permission to The Brick to collect, use and disclose Your personal information in accordance with The Brick’s privacy policy (“Privacy Policy”). The Brick is committed to protecting the privacy of the personal information You have provided herein. From time to time The Brick may use Your personal information to ascertain Your needs and market to You through commercial electronic messages, including Automatic Dialing Announcing Device telemarketing. If You do not wish Your information retained or to be used for these purposes, please contact Your local Brick store.

9. OTHER

The Brick reserves the right to amend or vary the contest rules, including the imposition or addition of new rules which are deemed necessary for business efficacy.

The Brick’s records of the winner selection process or any other aspect of this contest shall be final and conclusive for all purposes relating to this contest.

The Winner’s name shall be available upon request provided such demand is made within three months following the end of the Contest, by emailing: contests@thebrick.com and identifying the appropriate contest “Drayton Valley Furniture Photo Contest”.
